THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.6988 of 2016 ORDER:

The petitioner, who is sole accused, preferred the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.320 of 2016 of II Town Police Station, Mahabubnagar, registered for the offences punishable under Sections 354 (D) (1) (2) and 506 IPC.

The case of the prosecution is as under:

On 29.10.2015, the informant lodged a report alleging that though earlier she gave a complaint against the accused stating that he harassed her in the name of love and threatened to kill her if she fails to love him, there is no change in the attitude and on 19.09.2015 at 18.25 hours while she is at a clinic, near Boyanpally gate, the accused sent messages in vulgar language to her cell phone and also followed her with threatening messages. Heard learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State and perused the record.

Having regard to the nature of allegations made against the petitioner, I am not inclined to grant anticipatory bail to the petitioner.

However, the petitioner shall surrender before the concerned Court and make an application for regular bail after giving prior notice to the Public Prosecutor concerned, in which event the same shall be dealt with in accordance with law on the same day.

With the above direction, the criminal petition is disposed of.
