THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.42491 of 2016 ORDER:
When the matter is taken up for hearing, learned counsel for the petitioner submits that the issue raised in this writ petition is squarely covered by the order passed by this Court in W.P.No.40345 of 2014, dated 14.08.2019, and contends that the present writ petition also be disposed of in terms of the said order.
Learned Standing Counsel appearing for the respondents has not disputed the above submission.
In view of the above submissions and for the reasons alike in the order dated 14.08.2019 in W.P.No.40345 of 2014, this writ petition is also disposed of directing the petitioner to submit a fresh representation to the respondents seeking alternative employment of Record Tracer/Shramik, instead of Conductor, within a period of two weeks from the date of receipt of a copy of this order and, upon such representation being received, the respondents shall consider the same and pass appropriate orders in another two months thereafter. No order as to costs.
