This petition is filed by the petitioner-accused seeking to relax the condition imposed by the Judicial Magistrate of First Class, Luxettipet, Adilabad District, in Crl.M.P.No.329 of 2016 in Crime No.177 of 2015.
Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. In the order under challenge, the learned Magistrate while granting bail to the petitioner directed him to deposit his passport. Aggrieved by the said condition, the petitioner filed this petition.
Learned Counsel for the petitioner submitted that the petitioner is ready to face the trial, if any charge sheet is filed against him, and he will undertake to appear before the Court below as and when requires. Considering the facts and circumstances of the case, the above condition of deposit of passport of the petitioner alone is set aside. Rest of the order under challenge shall remain. If the passport of the petitioner has already been deposited, the Court below is directed to return the same to the petitioner.
