THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.5858 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondents in not extending the benefit of Family planning Increment in spite repeated representations of the petitioner as illegal, as high handed and arbitrary action, contrary to well established principles of law, and as such liable to be set aside in the interest of justice by directing the Respondents' to pay the arrears of increment from 01-08-2005 till date by re-fixing the pay of the petitioner forthwith."

Heard, Sri S.M. Subhan, learned counsel for the petitioner and Sri N. Vasudeva Reddy, learned Standing Counsel for respondents.

During the course of hearing, it is brought to the notice of this Court by learned counsel for the petitioner that for redressal of the grievance of the petitioner herein, the petitioner herein submitted a representation, dated 09-04-2012 and the same has not been disposed of so far by the respondents. It is also requested by learned counsel for the petitioner that the petitioner would make a fresh representation to the respondents and the same may be directed to be disposed of by the respondents, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Standing Counsel for respondents and this Court considers the said request as reasonable.

Recording the said submission and having regard to the nature of controversy, the writ petition is disposed of, without expressing any opinion on the merits of the matter and entitlement of the petitioner, keeping it open for the petitioner to submit fresh representation to the respondents for redressal of her grievance within a period of two (2) weeks from the date of receipt of a copy of this order and if any such representation is made same be considered and appropriate orders be passed by the respondents, in accordance with law, within a period of six (6) weeks thereafter. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
