Petition filed under Sections 437 & 439 of Cr. P.C. praying that in the circumstances stated in the Grounds of Criminal Petition, the High Court may be pleased to grant Regular Bail to Petitioner/Accused in connection with Crime No. 164 of 2018 on the file of the Gopalapuram Police Station, West Godavari District in the interest of justice These petition coming on for hearing, upon perusing the memorandum of grounds filed in support thereof and upon hearing the arguments of Sri Mangena Sree Rama Rao, Advocate for the Petitioner and of Public Prosecutor (AP) on behalf of Respondent-State, the Court made the following ORDER:-

SMT JUSTICE T. RAJANI CRIMINAL PETITION No.12730 of 2018 ORDER:

This petition is filed under Sections 437 and 439 of the Criminal Procedure Code seeking to enlarge the petitioner, who is the accused, on bail in Cr.No.164 of 2018 on the file of the Station House Officer, Gopalapuram Police Station, West Godavari District. The offence alleged is under Section 307 of the Indian Penal Code. 2.

Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the respondent.

The allegations as per the complaint are that the petitioner poured petrol in a fit of anger and set Fire to the victim. 4.

The counsel for the petitioner submits that the victim is discharged from the hospital and the petitioner has been in languishing in jail 15.09.2015 and that the investigation is almost complete. 5.

The learned Public Prosecutor does not refute the aforesaid submissions.

Hence, in view of the above, this Court does not find any reason to detain the petitioner in custody any longer. Hence, considering the above, the criminal petition is allowed and the petitioner is directed to be enlarged on bail on condition of his executing personal bond for Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to the satisfaction of the Judicial Magistrate of First Class, Kovvur and the petitioner is directed

t / to appear before the Station House Officer, Gopalapuram police Station, West Godavari District on every Monday and Friday between 10 AM and 12 Noon.
