THE HON'BLE SRI JUSTI CE CHALLA KODANDA RAM CONTEMPT CASE No.2388 of 2017 ORDER:
This Contempt Case was instituted alleging wilful disobedience to the order dated 08.03.2017 passed by this Court in W.P.M.P.No.8299 of 2017 in W.P.No.6758 of 2017.
Learned Standing Counsel appearing for respondents 2 and 3 - contemnors submits that the order dated 08.03.2017 of this Court has been complied with in all respects.
Though the learned counsel for the petitioners agrees with the aforestated submission, he submits that certain constructions were not demolished. He further submits that pillars have been left as it is on the road portion, which has been occupied by the private respondents. However, learned counsel for appearing respondents 2 and 3 submits that the illegal constructions made on 30 feet vide road were also demolished.
Recording the submission of the learned Standing Counsel appearing for respondents 2 and 3, the Contempt Case is closed. However, it is made clear that even at a later point of time, if the statement made on behalf of respondents 2 and 3 through their learned counsel comes out to be untruth statement, the petitioners are entitled to prosecute them for giving such false statement before this Court through their learned counsel. It is also further made clear that the apprehension of the petitioners that the private respondents would make constructions without obtaining any permission from the authorities concerned, cannot be considered at this stage, as it is only speculative. However, the
petitioners can avail appropriate remedies as and when such constructions are made.
