THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Writ Petition No.39074 of 2017 ORDER: (oral) (Per Hon'ble Sri Justice Suresh Kumar Kait) Vide present petition, the petitioner seeks direction thereby directing the respondent No.2 to produce the petitioner's sons namely (1)S.Sathwik, aged about 11 years and (2) S.Ruthwik, aged about 9 years, before this Court.

2) The present petition is filed on the ground that the petitioner's marriage was performed with 3rd respondent in the year 1999 and they were blessed with aforesaid children. They lived happily for a period of 15 years. Thereafter petitioner's wife started behaving strangely and for some reason or the other she is quarreling with the petitioner. On 18.03.2017, the petitioner issued a legal notice to the petitioner's wife to show petitioner's children but there is no response from his wife. The petitioner tried his best efforts to continue the matrimonial life but his wife i.e, third respondent is avoiding the petitioner with ulterior motive. 3) It is an admitted case that the aforesaid children are with their mother i.e, respondent No.3 and there is a dispute between the petitioner and respondent No.3. Therefore, respondent No.3 does not allow the petitioner to visit and see the children.

4) In view of the above, the present petition is not maintainable. The petitioner is at liberty to file appropriate petition before the appropriate forum.

5) Accordingly, this Writ Petition is dismissed. As a sequel, miscellaneous petitions, if any pending, shall stand closed.
