HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43072 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the respondents 1 to 5, in trying to evict the petitioner from the land admeasuring 108 cents situated at Sy.No.5-2-21 of Alapativari Street, Tadepalligudem, West Godavari District, without issuing any notice or without following due process of law, as illegal and arbitrary. Though various grounds are raised, the learned counsel for the petitioner submits that though the petitioner is in possession and enjoyment of the subject property, the respondent authorities are trying to dispossess the petitioner without following due process of law. No counter-affidavit has been filed by the respondents opposing the contentions of the petitioner.
Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the respondents to follow due process of law before taking any steps to dispossess the petitioner from the subject land, if the petitioner is in possession of the same. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
