HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.33571 of 2016 ORDER:

This writ petition is filed seeking a Writ of Mandamus declaring the action of the respondents in not disposing of the representations of the petitioner dated 04.08.2014 and 20.09.2016 as being illegal and arbitrary.

Heard Sri Gaddam Srinivas, learned counsel for the petitioner, the learned Government Pleader for Endowments(Telangana) representing the respondents 1 to 3 and Sri Ch.Satish Kumar, learned Standing counsel for Endowments (Telangana) representing the fourth respondent. 3.

It is the case of the petitioner that the fourth respondent temple was constructed nearly 75 years back. It is the further case of the petitioner that the father of the petitioner was recognised as founder member of the fourth respondent temple. After the death of his father, the petitioner submitted an application dated 04.08.2014 to the Assistant Commissioner of Endowments, i.e., the third respondent to recognize him as member of the founder family. Again the petitioner submitted another application to the third respondent on 20.09.2016 with a request to recognize him as a member of the founder family. For one reason or other, the third respondent has not disposed of the representation of the petitioner.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is that the third respondent may be directed to dispose of the representation of the petitioner dated 20.09.2016 as expeditiously as possible. The learned Assistant Government Pleader also consented for the same. 5.

In view of the submissions made by both the counsel, this Court is not inclined to go into the merits of the main case. 6.

Having regard to the facts and circumstances of the case and also the submissions made by both the counsel, the third respondent is hereby directed to consider and dispose of the application of the petitioner dated 20.09.2016 in the light of the provisions of Telangana Charitable and Hindu Religious Institutions and Endowments Act and the rules made there under as expeditiously as possible, preferably, within a period of one month from the date of receipt of copy of this order. 7.

With the above direction, the writ petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. No order as to costs.
