The case of the petitioner is that in pursuance to the impugned Provisional Assessment Notice dated 18-09-2017, the petitioner paid 50% of the amount on 21-09-2017 and also compounding fees, his power connection was restored and without sending the meter to MRT, the respondents are demanding to pay the remaining amount. Aggrieved by the same, the present writ petition is filed.
Heard both sides.
In view of the same, the respondents are directed to refer the matter to the Special Court under Section 154 of the Electricity Act for determination of the balance amount by following procedure and the petitioner is liable to pay the amounts, after the same is determined under Section 154 of the Act. Till then, the respondents shall not take any coercive steps for recovering the remaining amounts.
Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
