THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.29358 of 2016 ORDER:

The petitioner was appointed as driver in the year 1988 in the erstwhile A.P.S.R.T.C., and was working in the respondent No.3 Depot. When the petitioner was placed under suspension on 20.08.2016, this Court in W.P.No.22419/2016 set aside the order of suspension by giving liberty to the respondents therein to conduct an enquiry. An order of transfer was passed on 04.08.2016 transferring the petitioner from Midhani Depot to Uppal Depot. Challenging the same, the present writ petition was filed.

Learned counsel for the petitioner submits that the transfer in the middle of academic year is unwarranted and it is done as a punitive measure.

A reading of the impugned order of transfer shows that in compliance with the order of this Court in W.P.No.22419/2016, the suspension of petitioner was raised, but however, he was directed to report to the Depot Manager, Uppal. Such transfer is in the interest of organization. When an administrative order is passed in such a manner, this Court cannot interfere with the said order.
