THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.38338 of 2017 ORDER:

Heard the learned Counsel for the petitioners and the learned Standing Counsel for respondent No.1 It is the case of the first petitioner that he completed his Intermediate in April, 1998. Thereafter, he completed his Diploma in Physical Education in the year 2012. Similarly, the other petitioners also completed their Intermediate education and obtained Diploma in Physical Education. While so, the first respondent issued Notification No.08/2017, dated 06.02.2017, calling for applications for filling up of 616 posts of Physical Education Teachers in Residential Educational Institutions Societies and prescribing certain educational qualifications. The said notification was subsequently withdrawn. Another Notification No.16/17 was issued and the last date for submission of online applications was prescribed as 04.05.2017.

The notification was issued for 616 posts. The petitioners applied pursuant to the said notification and the written examination was held on 17.09.2017 and 18.09.2017. They came to know that few individuals approached this Court in W.P.No.16387 of 2017 challenging the said notification and this Court by order dated 28.04.2017 directed the respondents to entertain the applications filed by the petitioners therein and further directed not to announce the results.

Petition in W.P.No.18506 of 2017 challenging the very same notification is also pending before this Court. The present Writ Petition is filed challenging the eligibility of the graduates in PET for the post of Physical Education Teachers in Primary and Upper Primary Schools and further on the ground that since there was no demarcation of the vacancies on the basis of Primary, Upper Primary and Secondary/High Schools, it works hardship on the petitioners as they have to compete with the more qualified candidates. The Writ Petition filed on this basis cannot be entertained when the petitioners applied to the post pursuant to the notification and appeared for the written examination also. Learned Counsel for the petitioners could not show any rule or regulation earmarking the post of Physical Education Teachers for Primary Schools, Upper Primary Schools and High Schools. In view of the same, this Court sees no ground to entertain the present Writ Petition.

The Writ Petition is, accordingly, dismissed at the admission stage. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
