HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.43122 OF 2018 ORDER:

Heard Sri O.Manoher Reddy, learned counsel for the petitioner, learned Standing Counsel, appearing for respondent Nos.1, 3 and 5, learned Government Pleader for Roads and Buildings, appearing for respondent Nos.2 and 4, and learned Government Pleader for Finance and Planning, appearing for respondent No.6.

When the matter is taken up, written instructions, dated 30.11.2018, furnished by the Executive Engineer (R&B), are placed on record by the learned Government Pleader. The said instructions read as under:

"I submit that M/s.SRK Construction have filed a W.P. No.43122 of 2018 in the court of Hon'ble High Court Andhra Pradesh, Hyderabad, stating that the respondent 5th is threatening to deduct the free sand amount from running bills and that the action of the respondent is illegal and arbitrary and contrary to the order passed by the Hon'ble High Court A.P. Hyderabad. In this connection, I submit that the AGP AP Hyderabad, in their audit report has not mentioned the particular work. It is only petitioners apprehension. More over, the contractor is not using sand in the work and stone dust is being utilized. The work is in progress."

Having regard to the contents of the above instructions, this Court deems it appropriate to dispose of the Writ Petition by placing the aforesaid instructions on record.

Accordingly, the writ petition is disposed of. No costs.

Miscellaneous petitions, if any pending, shall also stand disposed of AVSS,J W.P. No.43122/2018 in consequence.
