HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.24084 of 2016 ORDER:
Vide the present petition, the petitioner seeks Mandamus declaring the action of the respondents in not paying the transportation charges and sub-wholesale dealers commission payable to the petitioner from 02.10.2005 to 30.04.2009 under "JANA KEROSENE PARIYOJANA SCHEME" introduced by the first respondent, as illegal, arbitrary and unjust and consequently to direct the respondents to pay the said amount to the petitioner forthwith.
Learned counsel appearing on behalf of the petitioner submits that as the issue in the present petition is squarely covered by the judgment of this Court passed in WP No.22799 of 2016, dated 19.07.2016, the same order may be passed in the present petition also.
In view of the submissions of learned counsel for the petitioner, the respondents are directed to submit the bills in terms of Jana Kerosene Pariyojana Scheme by complying the formalities, and on such submission, the respondents to process the claim of the petitioner and pass appropriate orders thereon, in accordance with law within a period of four (04) weeks from the date of receipt of a copy of this order. No costs.
With the above direction, this Writ Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed. ___________________________________ JUSTICE SURESH KUMAR KAIT.
