Siluveru , Kothi Venila Rani v. Siliveru Jeevan Kumar
THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO Tr.CMP.No.772 of 2018 O R D E R:
This Tr.CMP. is filed seeking transfer of FCOP.No.629 of 2018 from the Court of Principal District Judge, Nalgonda District at Nalgonda to the II Additional Family Court-cum-XV Additional District Judge, Ranga Reddy District at Kukatpally. 2.
Petitioner is the wife of the respondent.
3.
Respondent had filed the said O.P. seeking divorce from the petitioner under Section 10(x) of the Indian Divorce Act, 1869 making several allegations against the petitioner. 4.
Petitioner contends that she is a resident of Jagathgirigutta, Gajularamaram Circle, GHMC, Qutubullapur Mandal, MedchalMalkajgiri District, Hyderabad; that she is finding it difficult to travel from the said place, where she is residing with her parents, to Nalgonda, which is 150 kms. away and her parents are unable to accompany her for each and every adjournment. 5.
Though counsel for the respondent opposed the same and also filed a counter affidavit denying the allegations leveled by the petitioner and making other accusations against the petitioner, it is not denied that the petitioner is residing at Jagathgirigutta, Gajularamaram Circle, GHMC, Qutubullapur Mandal, MedchalMalkajgiri District, Hyderabad.
6.
In my considered opinion, petitioner cannot be compelled to travel to Nalgonda to fight the litigation against the respondent and it would be convenient to the petitioner if the matter is transferred to the II Additional Family Court-cum-XV Additional District Judge, Ranga Reddy District at Kukatpally. 7.
Therefore, this Tr.CMP. is allowed; the FCOP.No.629 of 2018 on the file of the Principal District Judge, Nalgonda District at Nalgonda is transferred to the file of the II Additional Family Court-cum-XV Additional District Judge, Ranga Reddy District at Kukatpally. No order as to costs.
8.
Consequently, miscellaneous petitions pending if any shall stand closed.
