THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.5979 OF 2017 ORDER:

This Civil Revision Petition is filed under Article 227 of the Constitution of India assailing the order dated 22.09.2017 passed in I.A.No.665 of 2017 in O.S.No.258 of 2014 on the file of the III Additional Junior Civil Judge at Nellore. 2.

Heard the learned counsel for both parties.

A perusal of the record reveals that the petitioners herein have filed O.S.No.258 of 2014 on the file of the III Additional Junior Civil Judge, Nellore, against the respondent for perpetual injunction in respect of the suit schedule property. After closure of the evidence on both sides, the petitioners filed I.A.No.665 of 2017 to issue summons to the Tahsildar of Nellore to cause production of RCB No.2084/2008. The petitioners also requested to issue summons to the then Tahsildar, Nellore, to identify his signatures on Exs.A.1 to A.3. The trial Court dismissed the said petition. Hence, the revision petition.

Today, this Court dismissed C.R.P.No.5980 of 2017 filed by the petitioners to reopen the suit to issue summons to the then Tahsildar, Nellore. In view of the dismissal of C.R.P.No.5980 of 2017, no further orders are necessary in this revision petition. 5.

In the result, the Civil Revision Petition is dismissed. There shall be no order as to costs.
