HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 43125 of 2018 ORDER:

1) Heard learned counsel for the petitioners and learned Standing Counsel for Greater Visakhapatnam Municipal Corporation.

2) The present Writ Petition came to be filed seeking issuance of writ of mandamus declaring the inaction of respondent No.2 in considering the complaint dated 01.11.2018, submitted by petitioner No.1, with regard to property admeasuring 588 square yards with D.Nos.54-1-25 and 54-7-1, situated in Survey No.43/2, Maddilipalem village, Visakhapatnam District, as arbitrary and illegal. 3) Though various grounds are raised, the grievance of the petitioners appears to be the inaction of the respondents - authorities in considering the representation dated 01.11.2018, seeking not to approve any building plan in favour of the unofficial respondents in respect of the above property, without intimation to the petitioners.

4) Learned Standing Counsel would submit that the said representation would be considered, in accordance with law, at the earliest.

5) Having regard to the above, the writ petition is disposed of directing the respondents - authorities to deal with the representation dated 01.11.2018, made by petitioner No.1, seeking not to approve any building plan in favour of the unofficial respondents in respect of the property admeasuring 588 square yards with D.Nos.54-1-25 and 54-7-1, situated in Survey No.43/2, Maddilipalem village, Visakhapatnam District, without intimation to the petitioners, in accordance with law, after hearing all the concerned including unofficial respondents, as early as possible, preferably within a period of three to five months from the date of receipt of a copy of the order. 6) There shall be no order as to costs.
