HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Contempt Case No.2425 of 2017 ORDER :

It is for the so called willful disobedience by the respondent-Land Acquisition Officer/ RDO, Nalgonda now Suryapet Division, of the orders of this Court, dt.30.12.2016 passed in C.R.P.No.3406 of 2016, the petition is filed.

The respondent during pendency of the petition deposited an amount of Rs.64,00,000/ -(Rupees sixty four lakhs only) or so and the balance due is about Rs.1,00,00,000/ -(Rupees one Crore only) approximately.

It is the submission of the learned Govt. Pleader for Arbitration representing the LAO/ respondent that there are calculation errors that are to be re-calculated before the executing Court pursuant to the direction of the Apex Court to approach the appropriate Court for the calculation differences and they are soon going to file an application before the executing Court to that effect.

Said submission is recorded but the same will not give any concession to them not to comply with the order of the Court passed wayback on 30.12.2016 even more than 20 months lapsed. In view of the above, the Contempt Petition is disposed of by directing them to deposit the entire amount due within 8 weeks from today as assured in the open Court without prejudice to the contest for the executing Court to invest the amount in civil Court deposit interest yielding and so to file within one week from the date of receipt of this order any such application for re-determination of the quantum by fresh calculation and it is therefrom on the calculative determination, the Decree Holders are entitled to what is the amount to be ascertained out

of the invested amount, for any excess to be reimbursed to the Government(LAO). It is made clear that if it is not complied with by deposit of the balance as per the above, the petitioners/ claimants are entitled to move fresh petition for contempt. Miscellaneous petitions, if any, pending in this Contempt Petition shall stand closed.
