HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CIVIL REVISION PETITION No. 3447 of 2016 ORDER:

Heard learned counsel for the petitioner.

The present Civil Revision Petition is filed challenging the very filing of E.A.No.148 of 2016 in E.A.No.319 of 2014 in O.E.P.No.136 of 2009 in O.S.No.143 of 2007 on the file of the Additional Senior Civil Judge, Tirupati.

The grievance of the petitioner appears to be that very filing of E.A.No.148 of 2016 is subject matter of challenge. If really, the petitioner is aggrieved by the filing of the E.A., he has to approach the trial Court and oppose the same by filing counter instead of approaching this Court directly. If the petitioner files counter in the above E.A., certainly the trial Court will hear the petitioner giving opportunity of raising all objections before the said Court. Having regard to the facts and circumstances of the case, the Civil Revision Petition is dismissed, giving liberty to the petitioner to approach the trial Court and oppose the application. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Civil Revision Petition, shall stand closed.
