CVNR,J & MSKJ,J WP.16945 of 2016 THE HON'BLE SRI JUSTI CE C.V.NAGARJUNA REDDY & THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL WRI T PETI TI ON No.16945 of 2016 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for the following substantive relief: "...to issue a writ, order or direction more particularly in the matter of writ of certiorari, calling for the records pertaining to E.A.No.5/2016 in CC No.24/2014 pending on the file of the District Consumer Forum, Vizianagaram i.e. 1st respondent by issuing the Notice dated 01.04.2016 by the 2nd respondent is illegal and arbitrary and violation of principles of natural justice and in violation of law and consequently quash the impugned notice dated 01.04.2016 passed by the 2nd respondent."
After arguing the case, Sri R.Siva Sai Swarup, learned counsel for the petitioners, seeks to withdraw the writ petition with liberty to his clients to avail the remedies available to them under the Consumer Protection Act, 1986.
The writ petition is accordingly dismissed as withdrawn with liberty to the petitioners in terms of the prayer made. As a sequel to dismissal of the writ petition, W.P.M.P.No.20871 of 2016 shall stand disposed of as infructuous.
