THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.12750 OF 2018 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioners, for grant of anticipatory bail in Crime No.250 of 2018 of Tiruchanur Police Station, Tirupati, Chittoor District, registered for the offence punishable under Section 363 read with 34 I.P.C. 2.

Heard the learned counsel for the petitioners, the learned Additional Public Prosecutor representing the respondent/State and perused the record.

Learned counsel for the petitioners would contend that the petitioners are apprehending arrest in the subject crime and prayed to allow this application.

On the other hand, the learned Additional Public Prosecutor would submit that though one accused was arrested and remanded to judicial custody in the subject crime, in the course of investigation, nothing has come up against the petitioners, and that the petitioners have not figured as accused in the subject crime yet.

In view of the submissions made by the learned Additional Public Prosecutor, the Station House Officer, Tiruchanur Police Station, Tirupati, Chittoor District shall refrain from arresting the petitioners in the subject crime.

Accordingly, the Criminal Petition is ordered.

Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
