THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.1264 OF 2017 JUDGMENT:

This Second Appeal is filed, by the defendants, under Section 100 of C.P.C., assailing the judgment and decree dated 25.01.2017 passed in A.S.No.5 of 2013 on the file of the Court of IX Additional District Judge, West Godavari at Kovvur, wherein and whereby the judgment and decree dated 21.06.2012 passed in O.S.No.147 of 2006 on the file of the Court of the Principal Senior Civil Judge, Kovvur, passing the preliminary decree for partition of the suit schedule property, was confirmed.

Learned counsel for the appellants filed a memo on behalf of the appellants.

Learned counsel for both parties submitted that the appeal may be closed, in view of the memo filed by the appellants. In view of the memo filed by the appellants, no further orders are necessary in this second appeal.

Hence, the Second Appeal is closed. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Second Appeal shall stand closed.
