O R D E R
The case of the petitioner is that the 7th respondent submitted an online application under Form-6(A) as per Rule 18 and Section 4(1) of the Andhra Pradesh Right in Land and Pattadar Pas Books Act, 1971 (for short 'the Act') on 28.07.2016 vide reference No.MU011602652899 before the 4th respondent in respect of the land admeasuring Ac.4-25 cents in Sy.No.126 for mutation of his name in the revenue records and for grant of pattadar pass books and title deeds. In respect of the same, though the petitioner submitted objections on 29.07.2016 before the respondents 2 to 4, without considering the same, the respondents 2 to 4 are proceedings to issue pattadar pass books and title deeds in favour of the respondent No.7. Aggrieved by the same, the present writ petition is filed.
Learned counsel for the petitioner submits that the petitioner filed objections on 29.07.2016 stating that third parties filed suit against the husband of the petitioner and the same was dismissed and confirmed in the first appeal. Against the same, second appeal is also filed and the same is pending. He further submits that the respondents may be directed to consider the said objections before disposing of the application filed by the 7th respondent.
Learned Assistant Government Pleader for Revenue produced written instructions issued by the Tahsildar, Rowthulapudi Mandal wherein it is stated that the petitioner's
name is entered in the occupant column but not in the pattdar column.
Since the objections filed by the petitioner on 29.07.2016 are stated to be pending before the 4th respondent, without expressing any opinion on merits of the case, the 4th respondent is directed to consider the same while disposing of the application filed by the 7th respondent.
With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed. ____________________________ A.RAJASHEKER REDDY,J Date: 23.08.2016 dv
