THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.36405 of 2017 ORDER:

The petitioner was appointed as a regular Conductor on 29.05.2002 on compassionate grounds under Bread Winner Scheme. It appears that on 03.08.2017 an incident occurred in the Depot involving the petitioner and one Smt.S.Sandhya Rani and in that connection a preliminary enquiry was conducted, which revealed that both of them were at fault. The preliminary enquiry revealed that their personal matters were brought inside the Depot instead of solving them outside. However, when both were suspended on 26.08.2017 under separate orders, she filed W.P.No.29632 of 2017 and this Court disposed of the said Writ Petition on 01.09.2017 setting aside the order of suspension and giving liberty to the second respondent to proceed with the enquiry pursuant to the charge memo already issued.

Since the preliminary enquiry revealed the involvement of both the employees, it is in the fitness of things that a similar treatment should be given in respect of the petitioner also by this Court.

Accordingly, the impugned order of suspension dated 26.08.2017 is set aside and liberty is given to the second respondent to conduct the enquiry pursuant to the charge sheet

issued on 26.08.2017. It is needless to observe that the petitioner shall cooperate for the conduct of enquiry. The Writ Petition is, accordingly, allowed in part. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
