THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9743 OF 2016 ORDER:

The criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking anticipatory bail in crime No.95 of 2016 on the file of the Women Police Station, Begumpet, registered for the offences under Sections 420, 498-A, 406, 506 read with Section 34 IPC and Sections 3, 4 and 6 of the Dowry Prohibition Act. Heard and perused.

The allegation against the petitioner herein is that the petitioner/A.1 along with the other accused harassed the daughter of the complainant in the United States of America (USA).

Learned counsel for the petitioner submits that the petitioner is now residing in USA and there is every likelihood of his arrest if he comes to India and as such, prays this Court to grant anticipatory bail to the petitioner.

This Court is of the view that admittedly the petitioner/A.1 is residing in USA and that no look-out notice is issued against the petitioner/A.1 and as such, the question of apprehension of arrest of the petitioner does not arise at this stage.
