THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36310 OF 2016 ORDER:
This writ petition is filed seeking to issue a writ or order more particularly, one in the nature of writ of mandamus to declare the action of respondent No.2 in not issuing Community Certificate on the ground that recommendations of respondent No.3 are not clear as illegal, arbitrary and violative of the provisions of the Andhra Pradesh (Scheduled Castes, Scheduled Tribes and Backward Classes) Issue of Community, Nativity and Date of Birth Certificate Rules, 1997 and consequently, to direct respondent No.2 to issue community certificate by considering the application, dated 23.9.2016, of the petitioner independently. 2.
Heard and perused the material available on record. 3.
Learned counsel for the petitioner submitted that respondent No.3 has already recommended respondent No.2 for issuance of the caste certificate to the petitioner, but till date, respondent No.2 has not issued the caste certificate and the petitioner is in need of the same for his further studies; that the petitioner has made an application to respondent No.2 on 23.9.2016 for issuance of the caste certificate and hence, prays to dispose of the said application expeditiously.

Considering the facts and circumstances of the case, respondent No.2 is directed to consider the application, dated 23.9.2016, of the petitioner and pass appropriate orders in accordance with law, as expeditiously as possible, preferably,
within a period of one month from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
