THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT CONTEMPT CASE Nos.2380 & 2398 OF 2016 COMMON ORDER:
Vide the present petitions, the petitioners seek a direction thereby to punish the respondents herein under Section 10 to 12 of Contempt of Court Act,1971 for their willful disobedience of the order of this Court dated 04.08.2016 passed in W.P.Nos.20797 and 20826 of 2016.
Learned Government Pleader for Land Acquisition (TG) appearing on behalf of the respondents/contemnors submits that the order dated 04.08.2016 passed in W.P.Nos.20797 and 20826 of 2016 has been belatedly complied with in letter and spirit as directed by this Court. She seeks unconditional apology on behalf of the respondents/contemnors on passing the delayed order. Learned counsel appearing on behalf of the petitioners does not dispute the same and submits that as the order has been complied with, he does not want to pursue the cases further against the respondents/contemnors and he has no objection if the present petitions are disposed of.
Before closing the present petitions, I hereby make it clear that the State Government should keep in mind, if a direction issued by the Court, they are bound to comply with the order. If there is any problem in complying with the order, the Government is duty bound to move an application before the Court for extension of time or otherwise.
I have come across a number of cases where the orders passed by this Court are not complied with by the Government. In the present matters, this Court is giving a last chance to the Government and its officers. If such type of the disobedience found in future, this Court will take strict action as required under law.
Keeping in view the fact that the respondents have complied with the directions passed by this Court, I hereby discharge the contempt proceedings against the respondents/contemnors. Accordingly, these Contempt Cases are disposed of. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE SURESH KUMAR KAIT.
