HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43212 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents 1 and 2 in interfering with the peaceful possession and enjoyment of the land of the petitioner admeasuring 1100 sq. yards of plot Nos.6 and 7, situated at Sy.No.41 of Madhapur Village, Serilingampalli Mandal, Ranga Reddy District and forcing the petitioner to transfer the entire land to the 1st respondent-Municipal Corporation without following due process of law, as illegal and arbitrary. Though various grounds are raised, learned counsel for the petitioner submits that any action which is going to be initiated by the respondents, in respect of the subject property, shall only be in accordance with law.

Sri Sampath Prabhakar Reddy, learned Standing Counsel for the respondents 1 and 2, would submit that the respondents 1 and 2 will not take any coercive steps without following due process of law. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the respondents 1 and 2 to follow due process of law while initiating any action in respect of the subject property. However, the petitioner shall not make any constructions without obtaining any permission from the concerned authority. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
