THE HON' BLE SRI JUSTI CE CHALLA KODANDA RAM CONTEMPT CASE No.3245 of 2018 ORDER:

This contempt case is filed alleging that the respondents 1 to 3 have wilfully violated the order dated 04.10.2018 passed by this Court in W.P.No.35869 of 2018, and thereby committed contempt of Court. 2.

The grievance of the petitioner in the writ petition was that the 4th respondent-Mohd. Raheemuddin Ansari was making illegal constructions in the open land admeasuring 2662 Sq.yads in Survey No.57 of Shivarampally, Katedan village, Rajendranagar Mandal, RR District; and though the petitioner complained about the same to the respondent authorities by way of submitting a representation on 10.04.2018, no action was taken by the respondents. This Court, by order dated 04.10.2018, disposed of the writ petition at the admission stage, without expressing any opinion, with a direction to respondents 1 to 3 to take necessary action on the representation dated 10.04.2018 submitted by the petitioner, in accordance with law. Alleging that the respondents 1 to 3 have not taken any action, this contempt case is filed.

In this contempt case, contempt is also alleged against the 4th respondent by making him a party respondent. Since there is no direction to the 4th respondent in the order dated 04.10.2018, there cannot be any contempt proceedings against the 4th respondent for his alleged demeanour. So far as the other respondents 1 to 3, inasmuch as the petitioner's representation dated 10.04.2018 was acted upon by the respondents by issuing notice to the individual who is said to have violated the municipal laws, and the order dated 04.10.2018 being a direction to the

Accordingly, the contempt case is closed without expressing any opinion with respect to further action. Miscellaneous petitions if any pending, shall also stand closed.
