THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No. 24833 of 2016 ORDER:
Vide the present petition, the petitioners seek direction thereby directing the respondents to pass a fresh Award, taking into consideration the structures existing in the land of the petitioners in Survey No.171/A of Gundavolu village, Rapur mandal, SPSR Nellore district.
2. Heard learned counsel for the petitioner and the learned Government Pleader for Land Acquisition (AP).
3. Learned counsel for the petitioner submits that instead of passing the Award by taking into consideration the structures existing on the land, the respondents have passed only ex-gratia; and the petitioner made a representation to that effect to the respondent Nos.2 and 3 on 04.07.2016 requesting to pass a fresh Award. The learned counsel further submits that this Court has dealt with a similar issue in W.P.No.1457 of 2010 and allowed the writ petition vide order dated 08.06.2016.
4. Therefore, keeping in view the averments in the writ affidavit and the submission of the petitioner's counsel, I deem it appropriate to dispose of the writ petition by directing the respondent Nos.2 and 3 to decide the representation dated 04.07.2016 submitted by the petitioner, within three weeks from the date of receipt of a copy of this order and
communicate the decision to the petitioner, in writing, within a week thereafter. It is needless to state that the respondents shall consider the orders passed by this Court in W.P.No.1457 of 2010, dated 08.06.2016, while deciding the representation of the petitioner.
