HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.131 of 2016 ORDER:

This petition is filed to withdraw A.S.No.129 of 2006 from the file of I Additional District Judge, Ranga Reddy District, and transfer the same to this Court to be heard along with A.S.No.1903 of 2003 pending before this Court.

2. According to the affidavit of petitioner, 1st respondent herein filed O.S.No.122 of 1995 for specific performance of agreement of sale dated 13.04.1994 and petitioner herein contested the said suit and suit was decreed on 30.06.2003 and petitioner herein preferred A.S.No.129 of 2006 before I Additional District Judge, Ranga Reddy and 2nd respondent herein preferred appeal before this Court against the very same judgment and to avoid conflicting decisions, both the appeals have to be heard by one Court and for that purpose, this transfer petition is filed to withdraw A.S.No.129 of 2006 from the file of I Additional District Judge, Ranga Reddy.

3. This Court permitted petitioner to take out personal notice to respondents through registered post with acknowledgment due and file proof of service and in compliance of the said order, advocate for petitioner filed memo on 04.04.2016 along with the postal acknowledgments of respondent Nos.1 and 2. In spite of service of notice respondents neither appeared in person

nor through any advocate.

4. Heard arguments.

5. Considering the reasons stated in the affidavit, A.S.No.129 of 2006 is withdrawn from I Additional District Judge, Ranga Reddy and transferred to this Court to be heard along with A.S.No.1903 of 2003.

6. Accordingly, this transfer C.M.P. is ordered.

7. Miscellaneous petitions pending, if any, shall stand closed.
