HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.25681 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction of the respondents in converting the petitioner's nominated retailer shop into Fair Price Shop of Lopudi village, Musunuru Mandal of Krishna District as illegal and arbitrary.
2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies for the State of Andhra Pradesh.
3. A perusal of the record reveals that the petitioner was appointed as retailer shop dealer for distribution of kerosene to the card-holders of Lopudi village. As per the circular issued by the Commissioner in No.PDS II(3)/2847/05 DATED 19.03.2005, the petitioner is fully qualified for appointment as a dealer for the Fair Price shop. It is further submitted that the respondents are taking steps to bifurcate Fair Price Shop No.4 into two shops in the village of Lopudi.
4. At the time of arguments, the only relief sought by the learned counsel for the petitioner is that the respondents may be directed to consider the representation of the petitioner as per law.
5. Having regard to the facts and circumstances of the case, the second respondent is hereby directed to consider the representation of the petitioner dated 20.07.2016 and pass appropriate orders in accordance with law, as expeditiously as possible, preferably, within a period of one month from the date of receipt of copy of this order.
6. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
