HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.64 of 2016 ORDER:

This petition is filed to withdraw O.P.No.1561 of 2015 from the file of Judge, Family Court, City Civil Court, Hyderabad and transfer the same to any competent court at Jangaon or to any other competent Court at Warangal.

Wife filed this petition and according to her affidavit, she filed OP No.2 of 2016 before Senior Civil Judge, Jangaon for restitution of conjugal rights and husband i.e., respondent herein filed O.P No.1561 of 2015 before Family Court, Hyderabad for dissolution of marriage and both the matters have to be tried by one court to avoid conflicting decisions.

Advocate for respondent reported no counter but represented that presence of husband i.e., respondent herein may be dispensed with before Jangaon Court for every adjournment.

Considering the submissions of both sides and also considering the affidavit filed in support of petition, O.P.No.1561 of 2015 is withdrawn from the file of Judge, Family Court, City Civil Court, Hyderabad and transferred to Senior Civil Judge, Jangaon for disposal in accordance with law. Senior Civil Judge, Jangaon shall dispense with the presence of respondent/husband for each and every adjournment. However he shall appear as and when his physical presence is felt necessary for any specific purpose.

5. Accordingly, this Transfer Civil Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
