HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43288 OF 2018 ORDER:

Heard learned counsel for the petitioners, learned Government Pleader for Municipal Corporation and Urban Development and learned Standing Counsel for Greater Warangal Municipal Corporation. 2.

Since this Court is not going into merits of the case, it may not be necessary to issue notice to the unofficial respondents. 3.

The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the inaction of respondent Nos.2 and 3 in not taking any action on the representations dated 12.11.2018, 15.11.2018 and 19.11.2018 made by the petitioners against respondent Nos.4 5o 6 to take appropriate action in accordance with law, as illegal and arbitrary. 4.

The grievance of the petitioner is that though representations were made on the aforesaid dates to the 3rd respondent, bringing to his notice about the unauthorized constructions made by the unofficial respondents, till date, no action has been taken.

Learned Standing counsel, on oral instructions, states that there was old compound wall with a small shed existing and that now the unofficial respondents are trying to renovate the same by increasing the height of the compound wall. It is also stated that the said construction activity has been stopped.

Learned counsel for the petitioners states that when the construction of the wall is illegal, respondents 1 to 3 should have taken action towards the alleged illegal construction.

Having regard to the above statement that the construction of the compound wall has been stopped, no further orders are necessary, But if the

unofficial respondents are proceeding with the construction contrary to the provisions of the law and without any permission, the authorities may take steps in accordance with law. It is needless to mention that the unofficial respondents shall not proceed with any construction without any permission. With the above observation, the writ petition is disposed of. No costs. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
