THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4808 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit it is therefore prayed that this Hon'ble Court may be pleased to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondent No.2 in considering the representation dated 04.01.2016 given by the petitioner is illegal, arbitrary and contrary to principles of natural justice and consequently direct respondent No.2 to pass orders on the representation dated 04.01.2016 given by the petitioner and pass such other further order or orders as this Honourable Court may deem fit and proper in the circumstances of the case." As the petitioner's representation dated 04.01.

2016 was admittedly received by the Greater Visakhapatnam Municipal Corporation, it would necessarily have to apply its mind thereto and take appropriate action in the matter, if warranted, in accordance with the due procedure. At this stage, entertainment of this writ petition and adjudication of the same on merits is therefore not warranted. In the light of the order proposed to be passed by this Court, it would not be necessary to put the unofficial respondents on notice. The writ petition is accordingly disposed of directing the Greater Visakhapatnam Municipal Corporation to consider the petitioner's representation dated 04.01.2016 and take appropriate action thereon in accordance with law.

It would be necessary that the Corporation give an opportunity of hearing to all parties concerned if it proposes to take any action which would be adverse to the interest of any party. The entire exercise shall be completed expeditiously and in any event, not later than two weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
