THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.43321 of 2018 ORDER:
The grievance of the petitioner-Association is with regard to the alleged misuse of funds collected from various sources by the fifth respondent, the former President of the petitioner-Association, and the failure of the State in taking steps in relation thereto by conducting an audit after seizing the records.
Sri S.Surender Reddy, learned counsel for the petitionerAssociation, states that the petitioner-Association is a registered body but is not in a position to indicate as to the enactment under which it has been registered, if at all. Further, the learned counsel is unable to explain as to how the State would be interested in the affairs of the petitionerAssociation to the extent of conducting an audit or an enquiry into its affairs. Unless a legal duty is cast upon the State to undertake such an exercise, it is not open to the petitioner-Association to file a writ petition complaining of inaction on the part of the State. The writ petition is therefore misconceived in its very inception and is accordingly dismissed. This order shall however not preclude the petitioner-Association from invoking appropriate remedies available to it in accordance with law.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
