THE HONOURABLE SRI JUSTICE RAGHVENDRA SINGH CHAUHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION NO.43326 OF 2018 ORDER: (per Hon'ble Sri Justice Raghvendra Singh Chauhan) The present Habeas Corpus petition is filed on the ground that M.Rajesh @ Ms.Chandramukhi Muvvala went missing from 27.11.2018 and has not been traced out by the police despite registration of F.I.R.No.1131 of 2018 of Banjara Hills Police Station. By order dated 28.11.2018 this Court has directed the learned Advocate General to ensure that the detenue is produced before this Court at 10.15 a.m. on 29.11.2018. Consequently, today the detenue was produced before this Court in the morning session. This Court directed that her statement should be recorded by the Registrar (Judicial) and be submitted to this Court before 04.00 p.m. Accordingly, her statement has been recorded and submitted by the Registrar (Judicial). The said statement shall be taken on record.
In her statement, she claims that she was taken in an Auto rickshaw, wherein she was accompanied by two persons and they threatened to kill her. She further claims that she was left with a cell phone and ear phones, and instructions were constantly given to her to travel from one place to the other. However, according to her, she came back Hyderabad, and contacted the persons of her transgender community. She along with her counsel went to Banjara Hills Police Station. She further states that she has come to Court on her own volition.
The statement given by the alleged detenue should be treated as a complaint against the two persons, who had allegedly abducted her and who had left her subsequently.
RSC,J & MSM,J Wp_43326_2018 The alleged detenue is no longer in illegal detention. Therefore, the writ petition stands disposed of.
However, considering the fact that the detenue has filed nomination papers for the upcoming election, and that the election is yet to take place, considering the fact that the detenue is still apprehending threat, this Court is of the opinion that police protection should be provided as and when requested by her. It is the duty of the police to protect the life and property of the detenue during the election campaign. The directions issued by this Court shall be complied with by the police. The copy of the statement of the detenue recorded by the Registrar (Judicial) shall be sent to the Director General of Police, Telangana State, for his information and necessary action.
The Registrar (Judicial) is directed to provide a copy of the statement of the alleged detenue to the Advocate General for the State of Telangana.
Consequently, miscellaneous petitions pending, if any, shall also stand dismissed.
