THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.5656 of 2017 ORDER:

This revision petition is filed under Article 227 of the Constitution of India challenging the orders dated 10.10.2017 in I.A.No.138 of 2017 in O.S.No.73 of 2009 on the file of the Court of Junior Civil Judge, Nandalur, Kadapa District. 2.

Heard the learned counsel for the petitioner, learned counsel for the respondent and perused the material on record. 3.

Learned counsel for the petitioner submitted that the petitioner could not cross-examine P.W.2 on the date fixed for his cross-examination; therefore, the petitioner filed I.A.No.138 of 2017 seeking to cross-examine P.W.2.

At the time of arguments, the only relief sought by the learned counsel for the revision petitioner is to direct the trial Court to dispose of I.A.No.138 of 2017 as expeditiously as possible.

In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the case. However, the learned Junior Civil Judge, Nandalur, is hereby directed to dispose of I.A.No.138 of 2017 in O.S.No.73 of 2009 in accordance with law as expeditiously as possible.

With the above observation, the Civil Revision Petition is disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
