THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.43718 OF 2016 ORDER:

This Writ Petition is filed seeking to declare the action of respondent No.2 in not considering the petitioner's representation, dated 09.10.2016, for release of Bolero vehicle bearing registration No.AP-24-TC-4430, as illegal and arbitrary.

The case of the petitioner is that his Bolero bearing registration No.AP-24-TC-4430 was seized on 17.09.2016 on the ground of violation of control orders issued under the provisions of Essential Commodities Act, 1955. He made a representation on 09.10.2016 to respondent No.2 for release of the said Bolero. As no orders are passed yet on the said representation, the present Writ Petition is filed. Heard learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.

Since enquiry is pending under Section 6-A of the Essential Commodities Act and no useful purpose will be served in keeping the vehicle idle, respondent No.2 is directed to release the Bolero of the petitioner on furnishing bank guarantee for an amount of Rs.3,00,000/- (Rupees three lakhs only).

With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs. __________________________ A. RAJASHEKER REDDY, J December 16, 2016.
