THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON No.4334 of 2002 ORDER:

The case of the petitioner is that she was appointed as Junior Assistant in the 3rd respondent college on 10.11.1992, admitted into grant-in-aid and she was fully qualified to hold the post of Lecturer. The petitioner was promoted as Senior Assistant on 03.07.2000. She filed this writ petition to consider her case for the post of Junior Lecturer in Commerce in the existing vacancy, as per the proposal of the 3rd respondent College, vide Rc.No.432/B1/Estt./2000-2001, dated 05.03.2001.

This Court, vide orders dated 25.11.2002, in WPMP.No.5389 of 2002, passed an interim direction to respondents Nos.1 and 2 to consider the case of the petitioner.

Counsel for the petitioner is absent. Learned Asst.Govt.Pleader for respondents Nos.1 and 2 states that in the counter affidavit filed on behalf of respondents Nos.1 and 2, at paragraph No.7, it is clearly stated that as per the interim order of this court, dated 25.11.2002, passed in WPMP.No.5389/2002, the proposal of the 3rd respondent college, dated 05.03.2001, has been reconsidered and rejected, as per the Directors Proceedings Rc.No.516/Admn.III-3/02, dated 10.09.2003, and hence, no cause survives in this writ petition.

As per the averments of the counter affidavit of respondents Nos.1 and 2 and according to submissions of the learned Asst.Govt.Pleader, the case of the petitioner has already been considered and rejected, and

MGR,J WP_4334_2002 hence the cause in this writ petition does not survive and has become infructuous.

The writ petition is accordingly dismissed as infructuous. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
