2016-11-18S.V.Bhatt1 pages

THE HON'BLE SRI JUSTI CE S.V.BHATT W RI T PETI TI ON No.3 9 9 1 4 of 2 0 1 6 ORDER:

The third respondent through proceedings dated 03.11.2016 cancelled the authorization of petitioner.

The petitioner, on 14.11.2016, filed an appeal before the second respondent along with a petition seeking stay of the proceedings dated 03.11.2016. 2.

Though the dates, referred to above, are in quick succession, the reason why the petitioner has invoked the jurisdiction of this Court is that pending enquiry before the third respondent, the petitioner was allowed to distribute essential commodities and therefore, he prays for appropriate direction to second respondent to take up and pass orders as are deemed fit in the facts and circumstances of this case on the stay petition filed by him.

Hence, the writ petition is disposed of by this order: The second respondent is directed to pass orders on the stay petition filed by the petitioner within ten (10) days from today and also consider disposing of the appeal within eight (8) weeks thereafter. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
