K Subba Rao v. Statae Bank Of India And 2 Others
THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.36826 of 2017 ORDER:
Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents. 2.
The petitioner is an Ex-Service man and was appointed as Armed Guard in the year 2003. He was posted to Innespeta branch of Rajahmundry, where he worked from 10.01.2003 to 05.11.2011. He was transferred to Dowleswaram Branch, where he worked from 05.11.2011 to 29.11.2014. He worked in Alkot Garden Branch from 29.11.2014 to 29.07.2016. He was appointed as Head Armed Guard and was again posted to Dowleswaram Branch on 29.07.2016. Now, when an order was passed on 05.10.2017 transferring him from Dowleswaram Branch to Rekapalli Branch of East Godavari District, the present Writ Petition is filed.
3.
Learned counsel for the petitioner submits that the petitioner comes under Sub-ordinate staff under para-536 of the Sastry Award and he cannot be transferred within a period of one year. 4.
Learned counsel for the respondents submits that the Sastry Award speaks on prohibition of transfer outside State or any other language area, except with his consent.
5.
Now, the petitioner is transferred to another branch within the same District and whatever the exigency service it is not known to this Court. This Court will not interfere with the orders of transfer unless they are mala fide or without jurisdiction. Those two grounds are not urged in the present Writ Petition.
6.
In the circumstances, this Court is not inclined to interfere with the order of transfer, dated 05.10.2017, but gives liberty to the petitioner to submit a representation to the concerned authority, if there is any hardship faced by the petitioner. 7.
With the above direction, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed. There shall be no order as to costs. ________________________________ A.RAMALINGESWARA RAO, J DECEMBER 13, 2017 YVL
