THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21889 of 2016 ORDER :

Heard the learned counsel for the petitioner and Sri R.Sudheer, learned Standing Counsel appearing for respondent Nos.2 and 3. At their request, the Writ Petition is being taken up for disposal at the admission stage. Since this court is not deciding the case on merits, it may not be necessary to hear unofficial respondents 4 and 5.

2. The prayer of the petitioner in this case is as under: "...to issue Writ, Order or Direction more particularly in the nature of Writ Of Mandamus declaring the action of the respondents 1 to 3 in not taking action against the 4th & 5th respondents illegal encroachments made on the road between Plot No.42 and 43 Revenue Employees Colony, Moghalrajapuram, Vijayawada as illegal, void, arbitrary and against to law and consequently allot the vacant land available to the petitioners society for the purpose of community hall and pass..."

3. It is the grievance of the petitioner that though number of representations were made to respondent No.2 bringing to its notice the illegal encroachments made by respondents 4 and 5 on the road between Plot No.42 and 43, Revenue Employees Colony, Moghalrajapuram, Vijayawada, no action is taken up till date. The learned Standing Counsel appearing for respondent Nos. 2 and 3, on instructions, states that action will be initiated in

accordance with law, on the representations made by the petitioner.

4. Recording the said statement, the Writ Petition is disposed of directing the respondents 2 and 3 to take appropriate action in accordance with law, on the representation made by the petitioner in the month of April, 2016, within a period of six weeks from the date of receipt of a copy of this order. It is needless to mention that before passing any order on the said representation, personal hearing shall be given not only to the unofficial respondents 4 and 5 but to the petitioner also. Pending miscellaneous petitions, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
