THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1275 of 2016

ORDER

This criminal petition under sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner-A4 seeking to grant bail in connection with Cr.No.24 of 2015 of Rolugunta Police Station, Visakhapatnam District, registered for the offence punishable under Section 20(i)(b) and 25 of NDPS Act, 1985.

2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor.

3. It is alleged that on 05.01.2016 at 8.00 hours, on information, the Excise Officials reached Bhogapuram Junction and caught hold of two persons, who disclosed with regard to their ganja business along with A4 illegally, and on inspection of a lorry, they found 280 Kgs of ganja in 140 bags transporting illegally.

4. The petitioner is in judicial custody since 05.01.2016. Since the contraband seized from the possession of the accused is a commercial quantity, this Court is not inclined to grant bail to him. 5.

Hence, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this criminal petition shall stand dismissed. _____________________ JUSTICE RAJA ELANGO 10th February, 2016 sj
