HON'BLE SRI JUSTICE S.V. BHATT W.P.No.44315 OF 2016 ORDER:

The prayer is one against inaction in hearing the stay petition filed on 05.11.2016 or appeal filed against proceedings of respondent No.3.

The petitioner, it is alleged, filed appeal against proceedings, dated 14.09.2016, before respondent No.2. Respondent No.2 did not give a date for hearing of stay petition or has given a date for hearing the appeal.

Since the prayer is against inac tion in disposing of the stay petition/ appeal, I am satisfied the writ petition is disposed of by this order:

" Respondent No.2 is directed to fix a date for hearing of stay petition within four weeks from the date of receipt of copy of this order, afford opportunity to petitioner herein and pass orders as are deemed fit and proper in the circumstances of the case. Likewise, respondent No.2 is also directed to dispose of the appeal within three months thereafter." There shall be no order as to costs. Consequently, pending miscellaneous petitions, if any, also stand disposed of.
