HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43413 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the respondents in not passing any orders on the application of the petitioner dated 20.6.2017, submitted under Section 53 of the Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 (for short, "the Act") for recognizing the petitioner as Mathadhipathi of Baba Balakdas Mutt, Dhoolpet, Hyderabad as illegal and arbitrary.

The learned counsel for the petitioners submits that though the petitioner submitted an application on 20.6.2017 to the respondent authorities requesting to recognize the petitioner as "Mathadhipathi" of Baba Balakdas Mutt, Dhoolpet, Hyderabad, as per the provisions of the Act, no action has been taken so far.

Learned Government Pleader for the Endowments, would submit that if the petitioner fulfills the requirements, the respondent authorities may be directed to pass appropriate orders on the application dated 20.06.2017, submitted by the petitioner under Section 53 of the Act, in accordance with law.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the respondent-authorities to deal with the application dated 20.06.2017, submitted by the petitioner under Section 53 of the Act, seeking to recognize the petitioner as "Mathadhipathi" of Baba Balakdas Mutt, Dhoolpet, Hyderabad and pass appropriate orders, in accordance with law as early as possible after giving reasonable opportunity of hearing to the petitioner and all concerned. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
