ORAL ORDER:

Heard learned counsel for petitioner and learned Government Pleader for Civil Supplies (AP).

This writ petition is filed challenging notification issued on 19.10.2018 calling for application for enlistment of new dealership for fair price shop No. 1335019, Maseedpuram, Mahanandi mandal, Nandyal division, Kurnool district. When the matter is taken up, learned Government Pleader produced photo copy of proceedings of Revenue Divisional Officer/3rd respondent in RDONDL:MIS/35/2017 dated 23.3.2018 wherein he has passed final orders of cancellation of authorization of petitioner. He in turn directed the Village Revenue Officer to serve copy of the same on petitioner.

The Village Revenue Officer visited the address given by the petitioner in Maseedupuram village and as petitioner was not available in the said address he gathered information from the villagers, who informed him that petitioner is not residing in the village, noted the same and obtained their signatures on his endorsement. Thus, he could not effect service of order dated 23.3.2018 on petitioner. Copy of proceedings dated 23.3.2018 are now served on learned counsel for petitioner. Thus, it cannot be said that decision taken by the respondents to issue notification to call for applications to enlist the new dealership is illegal, as dealership granted to petitioner earlier no more subsists.

Thus, writ petition is dismissed, leaving it open to petitioner to work out her remedies, if so advised, against the orders of third respondent dated 23.3.2018. No costs. Miscellaneous petitions, if any pending, are closed.
