HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.43338 of 2018 O R D E R:

This writ petition is filed challenging the action of the respondents in trying to interfere with the petitioner's peaceful possession and enjoyment of the land to an extent of Ac.0.48 cents in Sy.No.112/2 of Chinnavaddipally Village, Gannavaram Mandal, Krishna Distric, pending petitioner's application dated 29.10.2018 made to the 2nd respondent seeking correction of the wrong entries in the revenue record. Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Revenue produced written instructions stating that petitioner has not filed any application along with necessary documents; that the subject land was recorded as 'Nivasagruhalu' during 2014; and that neither the name of the petitioner nor the name of the 4th respondent is entered in the register. Learned Counsel for the petitioner alleges interference of the respondents over subject land.

Once it is stated in the written instructions that the subject land is a private property, the respondents cannot interfere with the petitioner's peaceful possession without following due process of law. If there is any dispute between

petitioner and 4th respondent the petitioner has to work out his remedies elsewhere.

Accordingly, the writ petition is disposed of. However, it is open for the petitioner to file necessary application along with documents to the competent authority and on such application the competent authority is directed to consider the same and take action in accordance with law. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the Writ Petition shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 05.12.2018 tk
