HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.43388 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: "to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to declare the action of the respondents in intending to allot the house site pattas in the land of the Zilla Parishad High School extent Ac.5.03 cents situated Sy.No.124/2 and 124/3 of Darsi Guntapeta Village, C.S.Puram Mandal, Prakasam District, as arbitrary and illegal and consequently direct the respondents not to allot house site pattas to the beneficiaries in the aforesaid land." 2.

Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents.

Learned Assistant Government for Revenue produced written instructions, wherein it is stated as follows: "I have enquired in the matter, and this is a long pending case in this mandal since 11 years. In this case the Collector and District Magistrate vide proceedings in Rc.No.E1/747/2007, Dt:04.10.2007 ordered to handover the advance possession of the said land in favour of respondent No.4, Z.P. CEO, Ongole for construction of Z.P. High School. It is respectfully submitted that once the land has been handed over to the local body in terms of Paragraph No.13 (a) of Standing Order No.84-A for purpose of construction of the school building, I have no right to cancel such allotment. Till date the higher authorities did not take any decision for cancellation of allotment of the land."

Recording the submissions made in the written instructions, the Writ Petition is closed.
