Sk. Siddaiah v. The State Of Ap
HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43398 OF 2018 ORDER:
Heard learned counsel for the petitioner, learned Government Pleader for Municipal Corporation and Urban Development and learned Standing Counsel for Municipality.
2.
The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of the respondents in not paying the due remuneration to the petitioner in pursuance of the instructions vide G.O.RT No.798, dated 02.05.2007 as unconstitutional and consequently direct the respondents to pay remuneration from 01.05.2015 till 30.04.2018 by considering the representation dated 18.04.2017. 3.
Though various grounds raised, the main grievance of the petitioner is that the petitioner appears to have made representation on 18.04.2017 seeking payment of due remuneration due, but the respondents did not pay the remuneration from 18.04.2017 till 30.04.2018. 4.
Learned standing counsel states that the petitioner may be directed to make fresh representation, in which event the respondents shall consider the same in accordance with law.
5.
Having regard to the above, the Writ Petition is disposed of directing the petitioner to make a fresh representation seeking remuneration, which is due from 18.04.2017 till 30.04.2018, in which event the authorities concerned shall deal with the fresh representation in accordance with law, as early as possible. No costs.
6.
Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
